Denver 10 Redux - some questions

The results of the ACBL EOC hearing held at the Orlando NABC concerning the “Denver 10” situation were:

Marilyn Eber – no charge proved 

Kay Enfield -no charge proved

Greg Hinze -no charge proved

Marty Seigman -no charge proved

Dana Hastings -no charge proved – dismissed – being appealed to A&C Committee

Jan Janitschke - dismissed in the interests of justice

David Grainger -negotiated settlement – 6 months probation

Cameron Doner -conduct violation of ACBL CDR 3.7

Sanction imposed =6 months probation

3.7 Actions or behavior unbecoming a person participating in an ACBL sanctioned tournament or event; or a person attending (at the time and site of) an ACBL sanctioned tournament or event or ACBL activity (including a unit or district activity).

Mark Lair & Dan Morse - conduct  violations of ACBL CDR 3.2 & 3.7

3.2 Violation of ACBL regulations. Administrative regulations such as rules pertaining to sanctioned games at clubs are exempted.

3.7 Actions or behavior unbecoming a person participating in an ACBL sanctioned tournament or event; or a person attending (at the time and site of) an ACBL sanctioned tournament or event or ACBL activity (including a unit or district activity).

Sanctions imposed: 30 day suspension + 1 year probation

Question: why was no charge brought against anyone under ACBL CDR 3.13 ?

3.13 Knowingly submitting false information to a tournament official, ACBL official or ACBL body

which is an ethical violation detailed in the ACBL CDR, Appendix B, E7

E7 Intentionally:

a. change a score

b. submit a false result of a hand, round or match,

c. change or submit any information that could result in awarding incorrect masterpoints or

d. enter an event for which you are not eligible

(CDR 3.1, 3.7 and CDR 3.13)

Recommended sanctions:1 to 3 year Probation and or up to 2 years Suspension*

10-50% of Disciplined Player’s total masterpoint holding

Question:what was the charge that could not be proven against Eber, Enfield, Hinze, Seligman, and Hastings?

Question: what was the charge against Janitschke, and what were the interests of justice served in the dismissal of that charge?

Question: what was the charge against David Grainger, and what section of the ACBL CDR was used to impose a negotiated settlement of 6 months probation?

Question: what part(s) did Doner, Morse & Lair play in the affair that the other seven did not? In other words, why were they the only ones sanctioned?
