Director rulling : French national matchpoint championship.

This board was played this week end during the French national Matchpoint championship and I would like to have the Bridgewinners community point of view.

*Was alerted Penalty by the doubler to south while East didn't alert and said "no agreement" after North Asked

Result was -1

NS called the director at the end of the round saying that had north known X was penatly they would be playing in 3DX making.

They explained that they never "put honey on sugar". IE : Never redouble a penalty double to play, so South though XX was something like 6-5 or more in the blacks. North saying he redoubled because he didn't want partner to bid over a 3S bid by east as he wanted to double them. He adds that he would not have redoubled had he been told X was penatly.

 

What do you think is the correct rulling ?

 

Additional question : How "allowed" it is to say no agreement on a sequence like this one in a supposedly top national event ? And who the director should beleive between East and West as to if they had an agreement or not knowing they didn't not have a CC.
