The facts :

1d was precision (10-15 2+ diamonds).  3d was intended as showing invitational or better hearts and not alerted.  Over the 5d bid, North started thinking, at which point South said "oh shit, alert".

The play went k of hearts lead to the ace.  South played a club which was won by East.  East returned a heart so South was able to ruff three clubs.  Table result was +620.

The director was summoned at some point (probably during the auction).  They returned with the verdict that table result stands based on the fact that South had no UI and could do whatever he wanted.

The appeal

EW appealed.  They said the director missed the point.  North has UI based on his partner's failure to alert the 3d bid.  They thought bidding 6d was a logical alternative to pass and that pass was strongly suggested by the UI.  Against 6d, EW said that a trump switch would be clear and would result in 6d down one -100.

N stated that when he was thinking, he was thinking about his ethical obligations.  A rebid of 4d would be forcing so his partner's 5d was extremely unusual and strongly suggested no interest in going any higher.  NS claimed that 5d is also self alerting that there is something bizarre going on since 3d bid would be unlimited in both shape and high cards and South would not jump to game like this with a forcing bid available.  They also contested that ew would not have beaten 6d anyway since there is no reason to not return a trump against 5d.

This was in a knockout match and the other table result was 5d-1.

How would you rule?

Table result stands.
