Is Partner's Failure to Alert UI?

I always thought that partner's alert, and explanation if asked, were unauthorized information to me.  In the same way, if partner doesn't alert when he should, that's UI too.

Playing with a pickup partner at a recent regional, the only odd choice on partner's convention card was "Bergen raises, on in competition".  Not wanting to make waves, I agreed to that, even though I've always played them Off IC .

A couple Swiss matches later, we had this auction:

Partner did not alert my 3 clubs.  After three spades went down 1, I explained the failure to alert.  At the compare, we learned that 4 made at the other table.  I was surprised that partner and both teammates felt I should have protected partner by bidding 4.  "Clearly he didn't realize that was a Bergen raise."   I explained that my 3 bid described my entire hand and taking any action based on partner's failure to alert isn't ethical.
